Contractors - Statement of Position Affecting Development Activities Involving the Waters of Lake Lure
Due to the declared State of Emergency within the Town, and ongoing recovery activities within the lake, no unauthorized entry on or into the waters of Lake Lure is currently permitted.
We recognize that this action may affect some private development, repairs, and maintenance activities, and this is the reason for publishing this statement of the Town’s position. While work on development and repair projects with existing, valid permits may continue, and new permit applications may be reviewed for approval, any permitted project plans must include a methodology that meets the restrictions of no unauthorized access to the lake, and those approved means must be adhered to. A violation of the lake access restrictions could result in the annulment of the project related permits.
We expect that this position will continue until at least November 14, 2024 but will be reconsidered for extension, if necessary, based upon the conditions affecting public health and safety at that time.
These limitations are based upon the current State of Emergency resulting from Hurricane Helene and the need to protect public health and safety during the extensive recovery and restoration activities. No viable alternatives to these limitation have been identified.
These limitations to, on or in the lake prohibit any non-authorized access within the normal shoreline limits of the waters of Lake Lure. Work is underway to remove the main debris fields within the lake and will be ongoing for the foreseeable future. That work, and the existing debris and sediment itself, has created extremely dangerous conditions in the lake. The recovery work will likely require substantial fluctuations in water levels, creating additional hazards.
