Marine Commission Meeting and Public Hearing Summary - Tuesday, December 12, 2023

Thank you to all those who joined the Regular Marine Commission Meeting and Public Hearing on Tuesday, December 12th, at 4:00 p.m.  The following is a summary of the meeting for those who could not attend.  

Please note that this is a summary of the meeting and not formal minutes which will be included in the next regular meeting packet.  You may download the meeting packet for additional information.   

I. Call to Order: Mayor Pritchett called the meeting to order.

II. Agenda Adoption: The agenda was adopted as written.

III. Lake Advisory Board Annual Report: Mrs. Kathi Hatfield provided a comprehensive overview of the work completed in 2024 and the board's plans for 2024.

IV. Public Hearing

A. Resolution No. 23-12-12 Amending the Lake Use Regulations

i. Staff Report

1) Page 8 - Letter L - you only have to submit the specification sheet once. 

2) Page 9 0 Letter Q 0- allows boat permits to be transferred 

3) Page 14 A - Boat operators must carry a digital or hard copy of their boat permit. 

4) Page 30 - Update to verbiage on requirements for having boaters permits. 

ii. Public Hearing: There was no public comment.

iii. Commission Deliberation: There was a brief discussion.

iv. Consideration for Adoption of Resolution No. 23-12-12 Amending the Lake Use Regulations: The resolution was adopted unanimously.

V. Public Comment: The public is invited to speak on any non-agenda and/or consent agenda topics. Comments should be limited to less than five minutes. There were no public comments.

VI. Consent Agenda: The consent agenda items below were approved.

A. Approval of the September 12, 2023, Regular Marine Commission Meeting Minutes

B. Adoption of the 2024 Marine Commission Meeting Schedule

VIII. Appeal Hearings

A. Request to Appeal Civil Citation No. 000066: Ms. Diane Rosemeyer has requested to appeal Civil Citation No. 000066 issued by Sgt. Carl Umphlett on September 15th for the operation of a boat without a valid permit. (See additional information in the meeting packet)  Diane Rosemeyer spoke regarding the situation and respectfully asked to appeal the citation.  Town Council voted to lower the fine from $250 to $100. 

B. Request to Appeal Civil Citation No. 000063: Ilmedin Husnic has requested to appeal Civil Citation No. 000063 issued by Sgt. Carl Umphlett on September 3rd for the operation of a boat without a valid permit. Mr. Husnic has stated that he is from out of town and was not aware of the need for a permit.  (See additional information in the meeting packet) The citation stands as written. 

IX. New Business

A. 2024 Lake Use Fee Schedule: 

  • Parks, Recreation, and Lake Staff drafted the proposed 2024 Lake Use Fee Schedule.
  • The proposed Fee Schedule was reviewed by the Lake Advisory Board and it was recommended that the 2024 Lake Use Fee Schedule be adopted, as presented.
  • There are two changes proposed: 

         1. Transfer fee will be changed from $10 to $25. 

         2. Vacation Rental fees will change from $2,000 to $3,000.

      The 2024 Lake Use Fee Schedule was approved as recommended.

B. 2024 Commercial Model: Parks, Recreation, and Lake Staff provided the proposed 2024 Commercial Model based the commercial applicants that fit the Model without exceeding the Model’s capacity.  The model was approved as recommended.
